Bobby Andrew Weaver, 24, made the application in Brisbane Supreme Court on Wednesday.
He was charged with the murder of David Thornton, 58, in April after police dug up remains in his Ipswich yard.
A freezer was excavated. It contained human remains belonging to Mr Thornton.
Police believe the alleged murder was carried out between January 24 and March 30 this year.
Mr Thornton was reported missing by his family on March 12.
